Two of the major cases I have been following for a long time ended in guilty pleas. I was in court for both.
Eduardo Martinez (Ice Cream Terror Guy)
My A/V request for Martinez was approved by Judge Murphy. I did record the entire proceeding where he pleaded guilty in a negotiated global disposition of dockets from White Plains, VOM and Larchmont but decided not to publish it, opting instead for one still photo. The defendant’s mental illness, his cooperative and polite manner and his supportive, distraught mother played a role in that decision. He is not quite done yet as he remaining dockets in Rye and VOM that were not part of the deal. He is back in Rye City Court next week. Not sure on VOM.
Man Pleads Guilty in Global Disposition of White Plains, Larchmont, Mamaroneck Dockets
Eduardo Martinez was granted a global plea agreement where he was sentenced on December 13, 2022, to 364 days on two separate cases where he entered two separate guilty pleas – Robbery in the Third Degree and Menacing in the Second Degree. His sentence of 364 days will run consecutive to one another and Orders of Protection were granted for each case.
Bethzy Higueros (Double Vehicular Homicide Gal)
Higueros asked to start serving her sentence early. Her promised sentence is max 3 years. She was ROR’d. She will appear before Judge McCarty on January 5, 2023 at which time she will be remanded to the Westchester County Jail. I will seek permission her appearance on 1/5/23 as well as her sentencing on 4/5/23. Below is a photo outside the courthouse from a previous appearance.
Bethzy Higueros, 23, of Pelham, NY, pleaded guilty to reduced charges related to a fatal car crash in Mamaroneck that killed two New Rochelle woman. She is scheduled for sentencing on April 5, 2023 where she faces up to 3 years in prison under a negotiated plea agreement where she pleaded guilty to Vehicular Manslaughter – 1st, a C Felony and DWI, an A Misdemeanor in exchange for 1 to 3 years in state prison plus fines and fees on the Felony charge and 364 days to run concurrent on the Misdemeanor charge plus fines and fees. Family members of the two victims will be afforded time at sentencing to deliver victim impact statements.

Percell Ross (Taxi Cab Murder Guy)
Big development in his case. Federal Defenders just requested an adjournment of his 12/21/22 suppression hearing to some TBD date in anticipation of a global multi-state settlement.
“The parties are in the process of negotiating a potential global resolution of this case that would not only resolve the instant matter but Mr. Ross’s pending state case in New York as well as additional charges in state court in Connecticut and Virginia.
I have requested permission to video record his appearance next week in White Plains and asked the federal court in Brooklyn for pleas and sentencing occurs across 4 courts in 3 states.
Rocah v. Costa (DA v. Judge)
Both parties have completed motion practice in this highly unusual Article 78 Complaint filed by Westchester County District Attorney Mimi Rocah against New Rochelle Judge Matthew J. Costa to prevent Judge Costa from enforcing his decisions to preclude evidence and testimony in a pair of drunk driving cases. I once again went to the courthouse to photograph the paper filing, converted the photos to PDF and uploaded then here:

Bronx Man Carjacks Vehicle, Intentionally Rams New Rochelle Police Vehicle, Injures NRPD Officer
Yonsin Macario Cordon (Child Rape Guy)
Yonsin Macario Cordon has filed a motion to dismiss. From what was said in court, the motion to dismiss is based on the case taking too long. He was back in court on 12/9/22. The people’s opposition was 12/21/22 but moved to 1/3/23 with a Control/Decision date of 2/6/22. I will request the motions once both are filed but before the decision.
Marcus Vasquez (Stella SWAT guy)
Marcus Vasquez, the guy surveilled by NRPD for days which sent a SWAT team to the Stella apartment building in downtown New Rochelle, was given an offer by the DA on Monday: a reduction to Criminal Possession of a Forged Instrument - 3rd, an A Misdemeanor, with a sentence of a 1 year ACD plus fines and fees. Not much to show for days of surveillance and a SWAT team raid at the Stella. He is due back in New Rochelle City Court for sentencing on January 23, 2023.
After court he asked me why I was recording him walking out of the courthouse. I told him I was covering his case. He asked who I was and I reminded him we had been neighbors at the Stella. Despite all this he got on the Stella elevator on the 6 floor with me and Zeke and went to the lobby. He asked about Zeke. Recall that weeks after his arrest, and license plates on his Blue BMW that came back stolen, his vehicle was back in the Stella. Whether he continues to reside at the Stella or is visiting you might think he would be banned from the building after drawing an armed response to the Stella and using a stolen identity to obtain a lease and parking.

Elijah Santiago (VIP Stabbing)
The DA is offering to let Santiago plead down to two felonies, Assault - 1 for one victim who sustained serious bodily injuries and Assault - 2 for the other victim. Assault - 1 has a minimum sentence of 5 years. The offer is 5 years in state prison on Assault - 1 and 3.5 years on Assault - 2 to run concurrent. Judge McCarty said the offer was “pretty good”. Santiago wants reductions to misdemeanors with no incarceration. Judge McCarty asked the ADA Strong if the DA would ever offer misdemeanors (“no”) or no incarceration (“no”). Judge McCarty said Santiago wanted to make a claim of self-defense, what he called an “all or nothing” defense. The case was adjourned to 2/23/23 by which time either the case would be resolved by plea or sent to a judge to assign a trial date.
There was an indictment and a partially granted omnibus motion in this case which we have requested from the DA.
James Bonanno (Little Jimmy)
Little Jimmy Bonanno said “Thank God” as he walked out the courtroom Thursday after a felony hearing ended when Judge Susan Capeci dismissed a Criminal Contempt - 1st Charge against him. He was apparently not listening closely to an easily overheard bench conference during the felony hearing where Judge Capeci and the prosecutor discussed the DA’s intention to take the matter to a Grand Jury to get the felony indictment instead of the felony hearing.
Louis Apicella (Sloppy Louis)
Apicella had an appearance Thursday as dockets for ShopRite Shoplifting and trying to run me over, case now transferred to Mount Vernon City Court. First Mount Vernon appearance Tuesday January 10, 2023 9:30 AM. I requested a copy of the transfer order from the DA but still do not have it.
Noam Bramson (Bent Mayor)
The DA said they do not comment on a Grand Jury investigation so until there is an indictment or no true bill there will be no information.
David Blumenthal (Bent Noam Pal)
Ethics investigation stalled. Best guess, nothing until after January 1st.
Michael Vaccaro (Bad Cop/Bad Cop)
Michael Vaccaro Termination Hearing is now scheduled for December 19.

There is another matter pending relevant to this case which is important but keeps falling to the bottom of my task list due to incoming stories on other subjects. I am hoping to get it done this weekend.

NOTES:, Martinez clearly has mental issues. He got out of hand in the VOM Court. He appeared to be under the impression that his 6 months in Valhalla was his sentence. He had not been sentenced. Judge Derrico ordered the court officer to remove him but let him listen from a nearby and told his lawyer and his mother to explain that his sentence may be longer than 6 months. Russell Smith, his 10-B attorney, said Martinez has a conference with Judge Cacace on 10/12 to discuss a global disposition of all the Mamaroneck cases (taxi robbery, ice cream store terror, etc.). Martinez was given a return date at VOM Court on 11/3/22. Judge Derrico instructed Smith to tell Judge Cacace her view that he needs mental health resources.
Discussion in court of a 1 year plus 1 year sentence and a new issue, immigration consequences for him. His lawyer asked for an adjournment because he could not meet with his client to a COVID quarantine. He violated probation 3 times (2 in MMK, 1 in Rye). There was mention of 2 grand larceny cases in White Plains that are news to me. The mother was present. There is a PSR. Case marked FINAL for 12/13/22.

NOTES: Posted bail, was in court. DA is offering to let Santiago plead down to two two felonies, Assault - 1 for one victim who sustained serious bodily injuries and Assault - 2 for the other victim. Assault - 1 has a minimum sentence of 5 years. The offer is 5 years in state prison on Assault - 1 and 3.5 years on Assault - 2 to run concurrent. Judge McCarty said the offer was “pretty good”. Santiago wants reductions to misdemeanors with no incarceration.
Judge McCarty asked the ADA Strong if the DA would ever offer misdemeanors (“no”) or no incarceration (“no”). Judge McCarty said Santiago wanted to make a claim of self-defense, what he called an “all or nothing” defense. The case was adjourned to 2/23/23 by which time either the case would be resolved by plea or sent to a judge to assign a trial date.
There was an indictment and a partially granted omnibus motion in this case which we have requested from the DA.
