NOTES:, Martinez clearly has mental issues. He got out of hand in the VOM Court. He appeared to be under the impression that his 6 months in Valhalla was his sentence. He had not been sentenced. Judge Derrico ordered the court officer to remove him but let him listen from a nearby and told his lawyer and his mother to explain that his sentence may be longer than 6 months. Russell Smith, his 18-B attorney, said Martinez has a conference with Judge Cacace on 10/12 to discuss a global disposition of all the Mamaroneck cases (taxi robbery, ice cream store terror, etc.). Martinez was given a return date at VOM Court on 11/3/22. Judge Derrico instructed Smith to tell Judge Cacace her view that he needs mental health resources.

Discussion in court of a 1 year plus 1 year sentence and a new issue, immigration consequences for him. His lawyer asked for an adjournment because he could not meet with his client to a COVID quarantine. He violated probation 3 times (2 in MMK, 1 in Rye). There was mention of 2 grand larceny cases in White Plains that are news to me. The mother was present. There is a PSR. Case marked FINAL for 12/13/22.

Eduardo Martinez appeared in Rye City Court on 1/3/23 on a misdemeanor Violation of Probation charge. His probation revoked and was resentenced to time served and 3 years probation (concurrent).

Eduardo Martinez appeared in Mamaroneck Village Court on 12/15/22 on a misdemeanor Violation of Probation charge. His probation revoked and was resentenced to time served and 3 years probation (concurrent)

All his open dockets are now closed. He remains incarcerated at Westchester County Jail until completion of his sentence.
